Terms of Service
These Terms of Service (the “Terms”) govern your use of sweetfin.com, our online ordering and catering pages, Sweetfan Rewards, gift cards, and any other Sweetfin service that links to them (together, the “Services”). The Services are operated by Sweetfin Holding LLC (“Sweetfin,” “we,” “us”).
By using the Services you agree to these Terms. If you do not agree, please do not use the Services. Our Privacy Policy and Cookie Policy are part of these Terms.
Changes to these Terms
We may update these Terms from time to time. When we do, we will change the effective date at the top of this page. If a change is significant, we will make that clear on the site. Continuing to use the Services after a change means you accept the updated Terms.
Who can use the Services
You must be at least 13 years old to use the Services, and at least 18 to place an order, hold a Sweetfan Rewards account, or enter into any transaction with us. If you are between 13 and 17, you may use the site only with the involvement of a parent or guardian.
Ordering and pickup
Online ordering, delivery scheduling, and Sweetfan Rewards run on platforms operated by our partners, including Thanx for ordering and rewards, and Olo and Spoonfed for catering. When you place an order through one of those platforms you are also subject to that provider’s own terms and privacy notice.
- Prices and availability. Menu items, prices, and hours vary by location and may change without notice. Photographs are representative, not exact.
- Order accuracy. Please check your order at pickup. If something is wrong, contact the location or our team and we will make it right.
- Cancellations and refunds. Refunds are handled under our Refund Policy.
- Delivery. Where delivery is offered through a third-party courier, that courier controls delivery times and handling once the order leaves the restaurant.
Food, ingredients and allergens
Sweetfin operates a dedicated gluten-free kitchen and does not use gluten-containing ingredients. Ingredients and suppliers can change, and our restaurants are shared spaces where guests and team members handle many foods. If you have celiac disease, a food allergy, or another dietary or medical restriction, please speak with the team at your location before ordering so they can walk you through current ingredients and preparation.
Nutritional and allergen information provided on the site is an estimate based on standard recipes and supplier data. Customized items will differ.
Sweetfan Rewards
Sweetfan Rewards is offered at our discretion and is subject to any program rules published with it. Points, credits, and offers have no cash value, cannot be sold or transferred, and may expire. We may change or end the program, or close an account, where there is fraud, abuse, or a violation of these Terms. You are responsible for keeping your account credentials secure and for activity that happens under your account.
Gift cards
Sweetfin gift cards are sold and serviced through inKind. Gift cards are redeemable for food and beverage at participating Sweetfin locations, are not reloadable unless stated, and are not redeemable for cash except where state law requires it. Lost or stolen cards can only be replaced if you can provide proof of purchase. Additional terms are presented at the time of purchase.
Merchandise
Merchandise sold through our online shop is subject to availability. Title and risk of loss pass to you when the carrier accepts the shipment. Returns follow our Refund Policy.
Promotions and offers
Discounts, promotional codes, and limited-time offers are valid only for the period, locations, and items stated, cannot be combined unless we say so, and may be withdrawn at any time. Offers are void where prohibited and have no cash value.
Text messages
If you opt in to our SMS program, the mobile terms in our Privacy Policy apply, including how to stop messages. You can text STOP to +1 (866) 718-4598 at any time to opt out, and HELP for assistance. Message and data rates may apply, and message frequency varies.
Content you submit
If you send us feedback, photos, reviews, recipe ideas, or other material through the Services or by tagging us publicly, you give Sweetfin a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that material in connection with our business, including on our site and social channels, with credit where practical. You confirm that you own the material or have the right to grant that license, and that it does not infringe anyone else’s rights. We are not obliged to use anything you send, and we may remove submissions at our discretion. Please do not send us confidential information.
Our content
The Sweetfin name, logo, menu descriptions, photography, site design, and other content on the Services are owned by Sweetfin or our licensors and are protected by copyright, trademark, and other laws. You may view and share our content for personal, non-commercial purposes. You may not copy, adapt, resell, scrape, or use it to train a machine-learning model without our written permission.
Acceptable use
When using the Services, please do not:
- interfere with, disable, or overload the site, or attempt to gain unauthorized access to any part of it;
- use automated tools to scrape, harvest, or bulk-download content, other than well-behaved search engine crawlers;
- submit false, fraudulent, or misleading orders or information;
- post anything unlawful, harassing, hateful, defamatory, or that infringes someone else’s rights;
- use the Services in any way that breaks applicable law.
Third-party services and links
The Services link to and embed tools operated by others, including our ordering, catering, gift card, mapping, payment, and accessibility providers. We do not control those services and are not responsible for their content, availability, or practices. Your use of them is governed by their own terms.
Accessibility
We want the Services to be usable by everyone. If you run into a barrier on this site, please tell us at info@sweetfin.com or through our contact form and we will work with you to provide the information or complete the transaction another way.
Disclaimers
Except where the law does not allow it, the Services are provided “as is” and “as available.” We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components, and we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms limits any warranty or right that cannot be limited under applicable law, including under California law.
Limitation of liability
To the fullest extent permitted by law, Sweetfin and its officers, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising out of your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the six months before the claim arose, or one hundred dollars. Some states do not allow these limits, and in that case they apply only to the extent permitted. Nothing here limits liability for gross negligence, willful misconduct, or personal injury caused by our negligence where that limitation is not permitted.
Indemnity
You agree to indemnify and hold Sweetfin harmless from claims, losses, and reasonable legal fees arising from your misuse of the Services, your violation of these Terms, or your violation of someone else’s rights.
Governing law and where disputes are heard
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Unless a binding dispute-resolution provision is added, any dispute will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you and Sweetfin consent to the jurisdiction of those courts.
General
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, Cookie Policy, and Refund Policy, are the entire agreement between you and Sweetfin about the Services.
